What exactly is a Legal Service?

In simpler terms, the services that advocates and lawyers offer, such as advice, consultation, or help in any area of the law, as well as representation in any court. So, Legal Services isn’t just limited to services that help people in court. Legal Services, on the other hand, also include giving advice or consulting on legal matters.

Applicability of GST Registration on Lawyers

Goods and Services Tax (GST) is charged to law firms and lawyers who do any kind of legal work for a business or organisation that made more than Rs. 20 Lakh in sales or revenue in the previous year. Also, GST on legal services will be due when a senior advocate gives services to a lawyer from another firm or to any other expert. So, in these cases, lawyers need to apply for GST Registration in India and then go to GST Return Filing.

Also, under the Goods and Services Tax Act, all law firms and lawyers who offer legal services to businesses outside of India must register in order to avoid getting in trouble with the GST Law.

Important Note: The Reverse Charge Mechanism is used to decide whether or not lawyers need to register for GST. Section 9(3) of the CGST Act and Section 5(3) of the IGST Act say that any payments due under RCM must be paid up front. But you can’t use the Input tax credit to pay off a reverse charge debt.

What exactly is the Reverse Charge Mechanism?

The basic idea behind indirect taxes is that the producer, seller, or service provider gets the tax from the person who buys the product or service. After the manufacturer or service provider has adjusted their production obligation, they send the tax to the Indian tax authorities. A private attorney, especially a senior private attorney, provides legal services at the GST rate and pays GST through a Reverse Charge Mechanism.

Exemption of GST Registration for Lawyers

Lawyers don’t have to register for GST if they only offer their services to-

Businesses with sales of up to Rs 20 lakhs and businesses in the North-East with sales of up to Rs 10 lakhs.
Any person who is not a business company and needs legal help from a senior advocate.
